Not least, tax regulations must also be taken into account. If you sell a property that you have used yourself, no tax is due. However, if the property is rented out or used commercially, it must have been in your possession for at least 10 years. Otherwise, the so-called speculation tax must be paid. In this regard, the legislature refers to the date of the notarization of the purchase contracts. The land transfer tax must always be paid. However, this is usually borne by the buyer. The amount of the land transfer tax is a matter for the federal states and is set by the respective federal states themselves.

A professional real estate agency is a service agreed upon between the client and the real estate agent. After the service has been provided, a commission, known as the agent’s fee, is due. Who pays the commission depends on the type of commission and the reason for the commission. If you sell your property through an agent, the buyer usually pays the commission. Since 2015, the principal principle has applied to rentals, so that the recipient of the invoice and the person paying the commission are the same as the person who commissioned the real estate service.
