Selling property in Spain: Taxes
The sale of a property entails certain conditions. These include, among other things, the tax requirements. Here is a brief summary of these.
If you are in Spain for less than 183 days per year, you are not liable for unlimited taxation as a property owner. When signing the notarial purchase contract, 3% of the purchase price will be deducted from the buyer as an advance tax payment, and the buyer must pay this tax amount to the Spanish tax authorities within 30 days. In addition, as a seller of real estate, you are obliged to file the profit tax return within 4 months after the notarial sale date.
At the state level, the tax rate is 19% (for EU citizens / non-tax residents). This 19% tax rate is applied to the difference between the purchase price and the sale price. For example, if you bought a property in Spain for €300,000 and sold it for €400,000, the difference would be €100,000. From this sum 19%, in this case 19,000 € tax is levied, which you must pay to the Spanish tax authorities.
Taxes on the sale of a property in Spain can be reduced by certain factors. Acquisition costs such as legal fees or sales costs such as estate agent fees are deductible up to a certain amount. If you are over 65 years old or have had permanent residence in the property for at least 3 years, the taxable profit tax can be reduced. However, you should discuss these factors individually with an expert.
